These terms apply to authorized users of the Yours Gynecologist web application and related online communication features (the “Service”). By accessing or using the Service, you agree to these terms. If you do not agree, do not use the Service.
1. Who may use the Service
The Service is intended for healthcare professionals and administrative staff authorized by your clinic or practice (“you” or “authorized users”). Access is granted through individual accounts and may be limited by role. You must keep your login credentials confidential and notify your administrator if you suspect unauthorized access.
2. Nature of the online communication service
The Service may include tools to coordinate patient-related communication, including integration with third-party messaging products (such as WhatsApp Business / Meta). Messages may be transmitted over networks and platforms outside our direct control. Your use of those channels is also subject to the third party’s terms, policies, and technical rules (including limits on when free-form “session” messages may be sent versus when approved templates are required).
Features and availability may change. We do not guarantee uninterrupted access or that any particular messaging outcome (delivery, read receipts, or window eligibility) will always match third-party behavior.
3. Not medical advice; not for emergencies
Content in the Service is for operational and communication coordination. It does not replace professional medical judgment, in-person examination, or formal medical advice. Nothing in the Service constitutes a doctor–patient relationship solely by virtue of using the platform.
Do not use chat or this Service for medical emergencies. If there is a risk to life or serious harm, contact local emergency services immediately. Patients should be instructed to use appropriate emergency routes when needed.
4. Privacy, confidentiality, and data
You are responsible for using the Service in line with applicable privacy and health-information laws and your organization’s policies (which may include HIPAA or similar rules, depending on your jurisdiction and setup). You should only access, send, or store the minimum information necessary for legitimate care and operations.
Third-party messaging providers process message content according to their own terms. Your organization should have appropriate agreements, notices, and consents in place for how patient data is communicated.
5. Acceptable use
You agree not to:
- Use the Service for unlawful, harassing, or abusive communication.
- Share account access or attempt to bypass security or access controls.
- Upload malicious code or interfere with the integrity or availability of the Service.
- Use the Service to send unsolicited marketing in violation of applicable law or platform rules.
6. Intellectual property
The Service, including its design, branding, and software, is owned by its licensors or operators. You receive a limited, non-exclusive right to use the Service for its intended purpose during your authorization period.
7. Disclaimers
The Service is provided “as is” to the extent permitted by law. We disclaim warranties not expressly stated here. Third-party services (including messaging carriers) may fail, delay, or change behavior without notice.
8. Limitation of liability
To the fullest extent permitted by applicable law, we and our affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service or reliance on communications sent through it. Your organization’s agreements may supersede or supplement this section where applicable.
9. Changes
We may update these terms from time to time. Continued use after changes become effective constitutes acceptance of the revised terms, except where a stricter notice period is required by law.
